- Job Summary:
- The purpose of this position is to oversee activities related to the protection of an organization's interests in lawsuits, pre-litigation processes, and advising on ways to avoid litigation in a court of law.
- Responsibilities:
- Stay up-to-date with amendments to various laws, rules, and regulations made by federal, provincial, and other statutory bodies.
- Evaluate the probable effect on operations or relations with others and provide guidance accordingly.
- Anticipate and proactively develop strategies to address changes in regulatory requirements and public policy.
- Review drafts of impending legislation, evaluate the probable effect, and advise on possible steps to protect the company's interests.
- Work with departments to collect necessary documents, follow up on lawsuits, or finalize other matters requiring input from the Legal department.
- Assist in developing a considered legal view on referred issues/cases/queries based on existing laws, rules, regulations, and research highlighting salient points of interest that may adversely impact the organization.
- Provide details of cases along with supporting documents to external counsel and share the company's legal perspective.
- Identify potential law firms/counsel and relevant specialization for litigation purposes.
- Assess the importance of lawsuits and suggest suitability of various legal counsel.
- Prepare and execute 'Vakalatnama' for appointment of legal counsel.
- Coordinate with legal counsel to initiate and follow up on lawsuits filed by the company or in suits where the company is a respondent.
- Develop and review appropriate drafts, briefs, replies, para-wise comments, opinions, and supporting papers ensuring SSGC's viewpoint is correctly presented and its interest safeguarded.
- Represent the company properly at hearings and ensure proceedings are documented and presented for review.
- Participate in preparation, vetting, publication, and service of legal notices in various matters.
- Seek feedback and clarification from stakeholders as required.
- Vett legal documents and drafts providing paragraph-wise input after adequate risk analysis and impact assessment.
- Represent the company's point of view before arbitrators or in discussions relating to dispute settlement out of court.
- Maintain effective working relationships with court officials to obtain copies of documents, filing of suits, and smooth execution of procedural formalities.
- Attend to litigation-related matters, report progress, and represent the company during court hearings as needed.
- Update members of the Public Accounts Committee (PAC) on ongoing cases during periodic meetings.
- Prepare status reports on lawsuits and ensure effective steps are taken to safeguard the company's interests.
- Generate periodic reports on potential legal and litigation risks.
- Study reports on decisions taken by superior courts, evaluate the probable effect, and advise on options available.
- Advise on changes or amendments in laws and rules along with applicable implications.
- Guide junior legal staff in developing initial drafts/replies/pleadings and review accordingly.
- Identify and assess risks under their management/ownership.
- Develop and implement risk response strategies.
- Monitor risks and response strategies.
- Ensure accuracy and timeliness of information provided for risk reporting.
- Perform any other work assigned by the immediate supervisor.
